Toyota gets most Florida, N.Y unintended-acceleration claims dismissed

Automotive News -- Toyota Motor Corp. won dismissal of most claims by Florida and New York car owners who contended the company drove down the value of their vehicles by failing to disclose or fix defects related to unintended acceleration.

Florida plaintiffs can't sue Toyota for economic loss if they didn't experience an actual "sudden unintended acceleration" event, said U.S. District Judge James Selna in Santa Ana, Calif., making final a tentative ruling from April.

New York plaintiffs are cut out if they didn't experience such an event or didn't have a measurable loss when trying to sell or trade in their vehicles, Selna said.

Friday's ruling will affect "most economic loss claims" in those states, said Carl Tobias, law professor at the University of Richmond in Virginia.

I suspect that the real truth is that after hearing about the runaway Lexus in San Diego, many people thought that they could use the Toyota recalls as a way to extort money from the company via tort claims. There was also some political and union glee to see Toyota losing sales after it had bested GM in world wide sales earlier. Like some other manufacturers, Toyota closed its only UAW plant in favor of plants in right-to-work states.

Agree with LuthierKS. Bad publicity by the media which should be punished so that it hurts the media. Lisbility for slander hould be handled correctly.

Excellent decision. All the evidence points to the drivers, not the motor car, in these "unintended acceleration" incidenses. These car owners should be sueing the media for sensationalizing these events, without a shred of evidence, not Toyota.

Do we really think all Toyota vehicle trade ins or resales were majorly decreased due to a debateable brake issue in another model? Maybe trade-ins or resales were low due to economy and big rebates off new vehicles that made buying new better than 1--3 yr old vehicles. Apparently the courts didn't think they proved their case against Toyota, at least on that issue.

What were the ages of the claiments ? Hate to say it but many of these were likely elderly drivers who confused one pedal for the other, and hopefully didn't take out any innocent bystanders in the process.

I think unless you drive a Toyota and have experienced any of the problems they were have been accused of, it is hard to make an intelligent analysis of the situation. I am not, nor have I ever been a Toyota owner- probably will never be, just not a big fan.

This was mostly a ruse. Toyota fixed it by equipping their gas with a device that shuts down the gas if the brake is applied, a fairly easy fix.
